Federal Court Begins Exploring Vaccine/Autism Link - Get the Latest, Share Your Thoughts!

Do vaccines cause autism? This question, which has haunted the autism community for more than a decade, is finally going to court. A special "vaccine court" will hear and read evidence from up to nine test cases from families who claim that vaccines caused their children's autism.

Are these court hearings worth the time and money? The New York Times published an editorial on the topic today, which suggests that:

The claims for or against an autism epidemic simply cannot be proved given the evidence available. (Public attention to the issue was set off primarily by a 1999 report by the State of California that found “a 273 percent increase in the number of persons with autism between 1987 and 1998.”) In the end, arguing over what the old data mean just detracts from the more pressing issues involved with scientific research and building cost-effective support systems for affected children, adults and their families.
That perspective seems to have some merit, since the ins and outs of the vaccine/autism debate are incredibly complex - and the arguments and proofs on each side are extremely persuasive. David Kirby, author of Evidence of Harm and blogger on the Huffington Post, provides a very full (and appropriately baffling) overview of how the case is likely to go - and even Kirby is uncertain as to the final outcome:
Monday will mark the first time ever that evidence of autistic harm from childhood vaccines is examined and cross-examined in a court of law. This is far from a slam dunk case for either side, and the stakes - professional, financial, emotional -- could not be more intense.

These three judges from the federal "Vaccine Court," as it is called, are about to dip into the raging, contradictory waters of the vaccine-autism contretemps, knowing they must emerge on the other side, each with their own acutely anticipated decision about causation. Ultimately, they must deliver judgment on some 4,800 claims that have been languishing in the system for years.

I do not envy them their task.

I certainly intend to follow the process of the vaccine courts, and will report along the way on what I learn. It's not difficult to do so: the US Court of Federal Claims offers both telephone and transcript access through its website.

This will be interesting to watch. Additionally, it should be noted that thymerisol is not the only culprit. Since banning the use of this preservative vaccine manufacturers have switched to using aluminum as a preservative, yet another metal that deposits in the brain. It is time for the drug companies to return to the days of live vaccines.

Unfortunately, the facts (or, if you prefer, ‘the science’) are squarely against any link. Moreover, the High Court in England has already ruled on the matter (http://www.bmj.com/cgi/content/full/326/7403/1351-a), as has - I believe - the Danish High Court, both finding against scaremongering and for rationality. I would be very suprised if this succeeds as an action.

I hope the courts decide for these children. Our son, with severe autism, is now 15. Diagnosed at 5 years. Perfectly normal until a vaccine injury.
After years of therapy, he can barely put 3 words together. Somebody should be held responsible.

The burden of proof will be interesting on both sides. I believe in the end, the High Court will say there was not enough concrete proof to sway them. and no, I do not work pharmaceutical company. I myself would also be surprised if this succeeds. and even if they do, it still does not prove the scientific flaws of what the actual cause is. it will only show a probable cause. people are convicted every day of things they never did due to probable cause.

this wont mean much to me either way it goes, there will still be many unansered questions.

Medical tests on the child given the psychological label “autism” may show high or low levels of mercury, depending on the ability to excrete it. The CDC’s epidemiological studies are irrelevant regarding this subgroup. I know a child whose biopsies show vaccine-strain measles in lesions lining the intestinal mucosa. Parents of ASD children should read about biomedical testing and treatment on the Autism Research Institute website. Urinary porphyrin profiles, intestinal scoping, and allergy panels are just a few of the tests to determine the child’s treatment plan. Many children show dramatic improvement simply after receiving nutritional supplements, since mercury leaches nutrients and kids are grossly deficient in B-12, magnesium, zinc, etc. Don’t be fooled by biased stakeholders or arbitrary authority figures. Look into the toxicology and immunology, and get the lab work done.

I don’t. I’m a lawyer, who has never worked for the pharmaceutical industry - in fact, I prosecute fraud. People aren’t allowed to read the case law and disagree with you without being industry stooges, is that it?

The Courts will decide on the basis of the evidence, which is - whether you like me saying it or not - that there is no causal relationship between MMR and autism.

The biggest problem as I see it is, that everyone is hanging their hats on Thymerisol. In my opinion it’s the shot and the timing of the vaccination. What is in the shot and how different is it from years ago? And why do the children have to be vaccinated so young? When I was a kid my mother had to have proof of vaccination before entering school.And to make another point I remember houses being quarantined. When was the last time you saw that? I know the argument is….That it hasn’t been seen because we take tiny babies now and shoot them up with all kinds of drugs.What ever happened to… Your child is born with an imune system that will last for [ ? months ] My Grandson was a beautyfull baby when he was born alert, smiling, up until the shot, then how can you put into words” YOU CAN’T “

To help answer the question of why vaccinate~ they call it childhood diseases because that’s the main age group the diseases affected. There are many web sites out there that shows how many children died and of what (and the current death rates within other countries). Partly because babies do not gain immunities until exposed, (until you send your child to daycare, they’re never sick. the minute they enter daycare, they’re sick all the time) and partly because babies and young children don’t cover their mouths when they cough or noses when they sneeze, nor use a tissue. Things go into their mouths that was just germed on. Partly because infants broncular tubes, lungs and other vital things are tiny. Way back in the days, they only quarantined for certain things and they still would today. Quarantined houses was not that far off, that would be my mother’s generation and she is still alive. Parents of her day were begging for a cure or prevention of these childhood diseases. What I find interesting is if we lived back then, but today, we wouldn’t be talking about autism and vaccines. We’d be talking about our children who died needlessly as my parents talk about. If they never created vaccines to prevent these things, that’s what our topic would be. Vaccines were actually invented to save lives, not brew autism. I grew up hearing all these stories, and I hope never to loose my child to a disease that could had been prevented. My husband has an aunt he never met who died from a childhood disease.

We can all stop vaccinating, let anyone enter this country from another that also never vaccinated, and see what happens. We can all wait for biological warfare and do nothing in means of protection. There has to be some middle ground of ’safe’. Safe to breath the air standing next to whoever and safe to protect ourselves if that air isn’t so safe.

If we’re concerned [which we should be} when a child enters pre k and putting them in the same inviroment with children that maybe sick, why give them shot when they’re 2/3/4 months old? I don’t think that ALL BABIES can take the vacine. Thymerisol or not. Thanks for the feed back

Anon—being a lawyer you should be able to connect the dots. To what extent, if there is a proven link, would Big Pharma go to to make sure ALL STUDIES would find NO link. Our own EPA says the amount of mercury a child would get injected into their bodies is hundreds of times more then what an adult could eat in fish. So why is it that the CDC all along has said Thimerasol is no big deal? Most of the people that create the vaccines are the ones that approve them. Look at “Dr. Paul Offit—do a search. He owns the patents on vaccines AND is one of the the “deciders” as to what vaccines must be mandated? Gee how much does he make? No conflict there at all.

The people that have autistic children know this is real yet the CDC and Big Pharma are just looking at profits and have been burying and hiding evidence for decades. Besides it has created a whole new industry for Big Pharma with the increase of Autism it is very healthy for their bottom line and that’s what’s it’s all about.

Anon—if you have a child imagine taking a vile full of mercury or Aluminum and shooting it into your day old baby—-sounds pretty stupid doesn’t it, unfortunately too many people find that out to late because they are told that the vaccines are safe…….who would EVER thing they are injecting heavy metals into their babies?

My boyfriends son was premature wasn’t his system already compromised ?( He was born at 28 weeks) Poor baby I think getting those vaccines harmed him .He is diagnosed with PDD-NOS , And Anon I read that link this was back in 2003 , alot has changed in the autism community in 4 years

my example of daycare was not meant to be pre K. I sent my child to daycare at 12 weeks old. If you look up the ages of when children died from these things, most never made it to pre K. That’s why they vaccinate at 2/3/4 mths old.

I do agree, vaccines are not safe for all kids. question is, how and when do you know that may be the case for your own child?

I am a mother of four with 2 autistic sons and a third that hasn’t been diagnosed yet.I feel like there is a cover up somewhere although the question is where?I watch the news and read the internet and all these things but I’m still unclear on what happened.Sometimes I’m angry but most of all sad,because are children are picking this up from somewhere,the problem is where.My oldest son I remember had loose bowle movements for a year and a half when he was about 14 months old,my other son projectile vomted everyytime he drank his milk when he was a baby,and know one can explain why but for some reason I belive the digestive tract plays a role in the start of when autism came into their lives it coinsides with vaccines and they ran high fevers but I need proof,before I convict.

When I was a child, I had a healthy baby brother who at about 2 mos of age received the DPT (diptheria pertussis tetanus) vaccine. Over the next few days he suffered seizures and made strange high pitched screams we had not heard before. We found him dead in his crib on the fifth day.

My family’s experience is anecdotal. The autopsy never yielded any results, as we were told my brother’s brain had been accidentally lost, and I cannot say for sure whether it was the vaccine that killed him. So I do not have anything scientific to add to the MMR / autism debate.

I only have this story.

I do believe there is enough evidence that links the vaccinations to SIDS, and AUTISM. The problem is who is doing the majority of the research???? Who else the pharma companies. Then we can talk about our congress backing all the Pharma research, well lets see one Senator( Frisk ) recieved 300,000.00+ from the a couple of these companies for his campaign contributions. Wake up folks it not a fair fight, do you think these companies are actually going to allow NON BIASED research to be done!!!Absolutely not. Millions and Millions of dollars are at stake. How many people died from many pharm. drugs being approved only to be recalled because the proof was overwhelming that they caused death.Watch T.V now we are being bombarded by commercials telling us we all are suffering from some illness and take there drug, and it will all be better….. Oh maybe except for the side effects of the drug that are scarier that the actual illness! Please if you are a parent, grandparent, research, research,please make informed choices for your children. There are many great web sights. Pediatricians are even coming forward and reconignizing there may be links. 1 in 150 children are now being diagnosed with Autism.(These statistics have gone up as more and more immunizations were introduced into an infants schedule.) I am no doctor. I am a mother of three and a grandmother of one. I have been told my children could NOT enter school without their Immunizations. This was completely untrue. I researched and some states have philisophical exemptions, medical exemptions and religious exemptions. My state only had religious exemptions. My children were allow in school and I never had another problem. Research all avenues before you take any ones word. I was told themirisol was no longer being used in vaccinations. That is comepletely untrue. It is!!! Your children depend on us as parents to make the educated decisions. Take the time to research, a mothers knowledge of her child is the greatest power of all!!!!

I have a premature child. He was born at 27 weeks. Not all children who received vaccines have autism. That means that there is something else at work. Not all vaccines had mercury as a preservative. Mercury has not been included in vaccines for the last 8 years. If mom eats a lot of fish while pregnant then there is a chance of mercury in her system passing to the baby. Autism has a genetic factor to it. Autism has been around for longer than vaccines. It just wasn’t recognized until the late 1940s. I am a mother and an autism researcher who is looking for the truth. Could mercury have helped? maybe. There is a genetic component to autism. It is a neurological disease that is identified with “bad wiring” in the brain. That’s why a if high functioing austics marry they have a high chance of having a severely autistic child. That’s why if one child in a family has it than there is a chance for a subsequent child to have autism. Learn the facts before you place blame somewhere. I too would rather immunize a child early on than hsave them suffer the affects of a disease that I could have prevented.

I have researched the subject since about 2000. I have come to the opinion that mercury is a toxin, and that it can do all the things that are listed under autism and autism spectrum disorders. The subject is an extremely complex one, and it is very hard to say whether one source (Thimerosal) or another dental amalgam, or another (vapor from a thermometer) has caused the damage. I get the sinking feeling that, since it seems to matter so much which one of them is the exact source, that it is going to be difficult to find proof with just one substance. A lawyer can always say it was something else that did it, and who is going to prove exactly what did it. There is no doubt, though, that all of those mercury sources affect the enzymes as well as any sulfur-containing vitaminsmuch more so than any other toxin with similar symptoms. There is a synergistic effect, too, meaning that mercury toxicity can be made much worse by, for instance antibiotics. One thing that can never be said is that Thimerosal is harmless even in tiny quantities. It does cause problems in the immune system and the dose per shot is not that well controlled. I have worked in a medical instrumentation company where the calibration of the quantities added as preservatives was highly questionable. I am affected by mercury every time I go to the dentist. I am allergic and sensitized to Hg-vapor. I also think the parents of those autistic children deserve their day in court. I only hope that the special masters are scientifically competent to see the mercurial nature of mercury. Birgit Calhoun

I am the mother of two high functioning autistic children. My son is 9 and my daughter is 7. I have done extensive research into my family history and into my husband’s family history. There is no evidence of autism in either of our families. If there is a genetic component, then my kids are the exception. Why do they have autism??? I don’t know. Did they get it from their vaccines??? I don’t know. If they did get it from their vaccines, then why aren’t ALL kids affected??? Why am I not autistic??? I was born well before they took out the mercury in the vaccines. I, like everyone else, have many, many questions. I’ll firmly stand by the fine folks in court, but I don’t think any link will be found, unfortunately.

If a family feels that they are in the same situation as the 4800 named in the trials, can they join the suit? If so, how would they do so? Or would they be better off going to civil court?

Any claim under the NVICP must be brought within 3 years of the onset of first symptoms or the manifestation of onset of the vaccine injury. If a family believes they may have a claim, they can contact the Court of Federal Claims or a lawyer who handles these cases. The Court of Federal Claims can give them a list of such lawyers.

I have a 3 year old son with autism and would like information on how to enter this lawsuit. I see there are others who would also like to join. Is there a website/general place/phone # available for families wanting to join?
Also, my baby is 10 months old and so far has received the recommended schedule of vaccinations. I have felt weary every time he’s received a set of shots and I’m to the point that I don’t know if I should even continue with the rest of the scheduled vaccinations. Any one else in this same boat? My thoughts and what I have read and have been told. Someone some where interviewed a nurse working for a family doctor whose patience were Amish. She was asked. { I don’t recall how many hundreds of families] How many children are there that have Autism in his Amish patience? The reply from the nurse was- Autism? There isn’t any! My daughter works in a doctors office for many years. She told me { true or not?]
that most paediatrcians do not get there children vacinated at an early age. One of my thoughts which I expressed earlier is. Let’s suppose[ murcury or not] that there is a hidden gene in a child.Why couldn’t it be POSSIBLE that all things being equal {Whatever that meens } A child just a few weeks or months old being subjected to vaccination it might be possible for their system to be so shocked as to bring on Autism ?

Hello, my son Brian was diagnosed with autism at the age of 2and a half. He had a reaaly bad reaction to the vaccinations MMR. We had to rush him to the hospital , he had a rash all over. From then on Brian was a totally different child. Brian was growing perfectly fine until those vaccines were given to him. Paul Offit in his Boston Globe editorial said we should be seeing a decline in autism since thimerosal was phased out of vaccines more than six years ago and the numbers of autism diagnosis have only increased. The fact is that the current number of cases are based on 8 yrs olds who were diagnosed in 1998-99 when thimerosal was not even starting to be phased out. Our pediatrician’s office in Cary, NC was still using thimerosal preserved shots for all of their DTaP shots as of May, 2005 when I specifically checked with them and of course, many if not most flu shots still contain thimerosal as of this posting. For specific information about the flu shot and the case against thimerosal as well as environmental mercury go to www.safeminds.org and for information about a possible CDC coverup go to www.putchildrenfirst.org. For information on biomedical treatments go to to www.advocates4children.com. Our son was diagnosed with autism, nonverbal and tested as severely retarded two years ago at almost three years of age. For us the GFCF (and eliminating other “reactive foods”) has made a huge difference along with other educational inverventions. I hope this information helps other families.

I have three sons. Two had grand mal seizures at age 3 months after their vaccines. One has autism, one developmental delay, and one is two young to diagnose. There is money set aside to help us and I want to be included before statute of limitations runs out for my oldest son.

My son Scott, who was developing normally, became severely autistic within 10 days of receiving vaccines at 18 mos. Scott is now 8yrs old and has been non-verbal and had little academic skill. Check this out, there has never been a documented case of Autism in Amish children…not one…wanna know why? they don’t give their children these vaccines. Whatever you believe there’s something our kids are exposed to that Amish children are not exposed to. The Govt. claims they took mercury (thimerosal) out of vaccines, and if you believe that or anything else this bought-and-paid-for Govt. says then there is no hope for this world. I have a twenty year old autistic adult son. He was diagnosed at the age of three although testing for some neurological condition began at five. I was a teenage mom and I did not always get my son vaccinated on time. The health departments in my area would simply combine the missed shots with the current shots to get him updated. I joined the Army in 1988 and left my son with my mother. When I left, he was using simple “baby talk” like da-da and ma-ma. I was gone for a year when my mom told me about the doctor’s concerns. I was horrified even though I did not know what autism was. I initially blamed myself for leaving my son behind, but after I researched the condition I realized that there was more to my son’s condition than I had realized. My son used to bounce his head on his pillow as he drifted off to sleep and again when he slowly awakened in the morning. I knew something was wrong only after the doctors began testing him. I remember the day I got the diagnosis, I was completely devastated. I gave of my dream of being a forensic pathologist so that I could be a better mom. Those first few years of his life were difficult. Only I could communicate with. It was not through speech or physical gestures but through my own intuition. Any illness required a trip to the local children’s hospital. The local clinics really did not know what to do with him. He was deathly afraid of any one in a white lab coat and would fly into a hysterical fit. As time went by we got used it and eventually we established a family routine. By this time 90% percent of my relationships with family and friends had died. It was like living in isolation. I kept him away from normal children and only allowed him to associate with his siblings. There were highs and lows. When his spoken vocabulary increased after MC Hammer’s song Too Legit to Quit came out. It was his first phrase. The low came later at the age of nine when he realized that he was different from other children. How I hurt for my son and at times it felt like I was dying inside. Later when his siblings ( 2 sisters) were in school, I learned that they to had developemental problems. The older daughter in AD and the younger one has a learning disability. It was then that I learned about the mercury based preservative in vaccinations. I was contacted by lawyers by in Jackson,MS (where my son began his testing that led to his diagnosis of autism. At first I was relieved. I thought I would get help for my son and maybe he could start alternative treatments. That hope soon faded as it dawned on me just what this lawsuit would mean if it was won. It would mean that I gave my son autism or at the very least msde it worst. The lawyers were particularly interested in how all of my children had varying degrees of developemental difficulties. I believed that it was a combination of genetics and some external factors. I new that mercury oxide caused genetic mutations in fish and I thought that it’s use has been restricted as to avoid in exposure to living organisms, particularly any that were subject to human interactions that led to contamination. How could this happen? Some time later, the lawyer contacted me and let me know that he was dropping my case. It seems that since I had not staked my claim within three years of his diagnosis, I/he was ineligible. That was in 2001 before the 9/11. I did not think about it again until my nephew started showing signs that were very similar to my son’s at that age. I resent government officials, legal representatives, and any member of the medical community that refuses to even consider the possibility of the innoculations as a contributing factor. They see this as a matter of dollars and cents. No amount a money can restore what my family has lost and continues to loose. The number of babies born with autism recorded in my research in 1990 was 4 in 10,000. As of September 4, 2006, the Center for Disease Control reports that 1 in 166 children are born with autism and that boys out number girls 4 to 1. After 9/11, businesses pressured the federal government to dis miss concerns about the vaccination-autism connection. It is not about the money!! It’s about the furture of our kids and their kids’ kids. Yes, I too would like to no how to get back in on the lawsuit. I know that when money is on the line-action is slow (ex. the national blood banks initial resistance to testing the nations blood supply for the AIDS virus).

This is likely a late post, but.. so much debate about something where the science is a done deal! Someone (or several) posts above said they believe Mercury (Hg) is toxic… as is Aluminum (Al); well guess what? It’s not an opinion, it’s a FACT. No question, no dispute.

The real question for the U.S. is whether and why we continue to CHOOSE to use these brain-body toxins, who it benefits, who it hurts, and why the wrong choices are continually made in the face of known undisputed science.

The drug industry uses Hg because of the increased shelf life of their product but it would be better for them to find better substitutes or accept some discarding of product rather than poison children — and certainly not use a toxin like Aluminum! Why does the ADA (Dental Assoc) still insist on Hg amalgams? By definition an “amalgam” is metals dissolved in Hg, but they avoid looking for alternatives. Why? Maybe as science usually faces in history: the advancement of science threatens those in charge; in the U.S. updating the science could invite lawsuits because the change is a tacit admission that the use of amalgam wasn’t such a good idea. Remember, Galileo was almost executed for insisting that the earth wasn’t the center of the universe, as the Catholic Church in charge preferred.

As usual in the U.S., FOLLOW THE MONEY. As long as drug companies and their ilk maintain TWO lobbyists PER Congress member holding out bags of campaign money, they will be invited in to “chat”, and the drug companies and the others will continue to be allowed, and in fact ENABLED, to do the wrong thing if it makes money for themselves. The cure to this problem is 1) public pressure on lawmakers at levels they’ve never experienced, and 2) public financing of all political campaigns. For conservatives who may dislike the latter, consider that we don’t have “one person one vote” today, we have “a million dollars one vote”. Hence detrimental decisions for most of us.

The science that says yes mercury is a toxic substance is indeed a done deal, the only heavy metal more toxic to human life is uranium, folks. If you want an expert’s opinion look up Dr. Boyd Haley’s Mercury toxicity and autism informationals on google video. Its in 4 parts, and he is very clear on the effects of mercury on the human body, heavy metal poisoning in particular mercury is his specialty. He was originally researching a connection between the vaccines given to soldier that might have been causal of the gulf-war syndrome and ended up presenting evidence to the powers that be of thimerosal’s dangerous and toxic nature and was told not to research thimerosal anymore. He’s watched cells in a petri dish die when they’ve added thimerosal…it may not cause autism by itself, but he’s positive its unhealthy and risky.

Hi if someone could also email me Abou getting into this lawsuit I would greatly appreciate it. I have twin boys that both have got a diagnosis for autism. Their therapist and specialist all find it strange how both boys have autism usually its one and not the other. My twins are ferternal and had seperate placentas and I really do believe the cause is vaccinations. The twins were both diagnosed at 2yrs 6mo. and now almost 3yrs. My son was mercury poisoned in 2001, at nearly two years old. After over 7,000 of research and countless treatments (all without mind-altering drugs) he is now almost “back,” at nine. *My pediatrician even nominated me to the Who’s Who in the Medical Industry - for research that began only to help my son!
